What do you need to know about GDPR ?

GDPR (General Data Protection Regulation) is a general data protection regulation accepted by the European Union. Earlier, there was only an EU guideline available about the management of personal data, but from now on GDPR has a compulsory effect, and is to be applied as generally binding in each member state of the European Union. Hence in the member states, unlike earlier, the most important rules to apply about the management and protection of personal data will not be the national regulation any more, but the DECREE 2016/679 (27th April, 2016) of the EUROPEAN PARLIAMENT AND THE COUNCIL that has been binding since 25th May 2018.
When our clients hear about the GDPR, we typically receive from them the following four questions:
1) Am I also affected?
In case somebody (independently of the organizational form) manages any data, it is necessary to prepare information materials and rules of data protection. Do you have an employee? Then you already are affected. GDPR has to be applied if your venture is operating in the EU, and its data management relates to this operation.
2) What is the worst that can happen? Who is in charge of control?
It is the NAIH (Nemzeti Adatvédelmi és Információszabadság Hatóság or National Authority for Data Protection and Freedom of Information) who is in charge of checking the adherence to GDPR. It can make inspections and can sanction the violation of data protection rules. The highest amount of the fine is 20 million euros or 4% of the global revenues of the preceding year, whichever is higher. Certainly it is the NAIH that decides about the necessary sanction.
3) What can I do?

The good news is that we have not yet heard news about an NAIH inspection made. This does not mean that there will not be initiated any soon.
